United States Attorney Alison J. Ramsdell announced the sentencing of Francis Lee Dubray, a 35-year-old resident of McLaughlin, South Dakota. U.S. District Judge Charles B. Kornmann sentenced Dubray to five years and ten months in federal prison for First Degree Burglary and two counts of Assault with a Dangerous Weapon. Following his prison term, Dubray will undergo three years of supervised release and must pay a $300 special assessment to the Federal Crime Victims Fund.
Dubray's conviction stems from an incident on July 5, 2023, at a residence within the Standing Rock Sioux Indian Reservation. Alongside two co-defendants, Dubray confronted a man they accused of inappropriate conduct towards a girl. Despite the homeowner's protests, one co-defendant forced entry into the home while Dubray remained outside, shouting at the woman for harboring the alleged offender.
Inside, Dubray's associates attacked the unconscious man, inflicting severe injuries including a broken nose and shattered orbital and sinus bones. As they exited, one co-defendant knocked down the woman; as she attempted to rise, Dubray kicked her in the face before fleeing.
The prosecution was handled by Assistant U.S. Attorney Carl Thunem under federal jurisdiction due to the Major Crimes Act requiring certain violent crimes in Indian country be prosecuted federally. The investigation was conducted by the FBI and Bureau of Indian Affairs – Office of Justice Services.
Dubray was taken into custody by the U.S. Marshals Service following his sentencing on June 16, 2025.
