U.S. Senators Mike Rounds (R-S.D.) and Angus King (I-Maine), both members of the Senate Select Committee on Intelligence, have introduced new legislation aimed at increasing penalties for unauthorized access to U.S. Intelligence Community property.
The proposed bill, called the Intelligence Community Property Security Act of 2025, would establish a specific provision in federal law prohibiting trespassing on sites under the jurisdiction of the United States intelligence community. It also seeks to strengthen punishments for repeated offenses related to such trespassing.
"Having unauthorized personnel trespassing onto some of our nation’s most sensitive sites presents a grave national security risk. We can’t take these offenses lightly,” said Rounds. “Our legislation would strengthen the punishment for repeated offenses and, in turn, better deter those bad actors who may try to infringe on these properties. Now more than ever, it’s critical to protect our intelligence sites from foreign adversaries.”
King commented on the importance of securing intelligence facilities: “The 21st century threat landscape is complicated, but there are some simple and straightforward steps we can take to protect our security and operations — like make sure that our Intelligence Community facilities are not compromised by unauthorized trespassers,” he said. “The bipartisan Intelligence Community Property Security Actwould take action to strengthen the penalties for bad actors and offenders attempting to intrude on intelligence sites. It’s commonsense legislation that will help better protect American people and interests.”
Currently, Title 18 of United States Code does not directly address criminal incursions onto U.S. intelligence community property. The new bill would update Title 18 so that incursions onto such property are expressly covered by federal law, revising criminal penalties according to the seriousness of the crime and potential threats posed by repeat offenders.
